Terms of Service

Welcome to Hallufox. These Terms of Service (the "Terms") are a legally binding agreement between you and ELITEHUB LIMITED ("Hallufox", "we", "us", or "our"), the operator of the Hallufox website, applications, and related services (together, the "Services").

By creating an account, accessing, or using the Services, you agree to these Terms and to every policy listed on our Legal Information page. If you do not agree, please do not use the Services.

In short: Hallufox is an entertainment platform where you chat with and create fictional AI characters. You must be 18+. Be respectful, follow the rules, and remember the AI is not a real person. We can suspend accounts that break these Terms.

1. About the Services

Hallufox is an online service that uses artificial intelligence to generate fictional, virtual characters ("AI Characters" or "AI Companions") that you can chat with and interact with through text and, where available, AI-generated images, voice, or video. You can use AI Characters we provide, or create your own by choosing their attributes.

The Services are provided for personal, non-commercial entertainment only. You agree not to use them for any commercial, illegal, or unauthorized purpose. We may add, change, or remove features, AI Characters, or content at any time.

2. Eligibility and age requirement

You must be at least 18 years old, or older if the age of majority or the minimum age for accessing adult content is higher where you live. By using the Services you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

We take age seriously. Please read our Underage Policy. We may ask you at any time to re-verify that you are an adult, and we may restrict or remove access if we cannot confirm this.

3. Your account

Some features require an account. When you register you agree to:

  • provide accurate and current information;
  • use only your own login credentials and payment methods;
  • keep your password confidential and not share your account; and
  • be responsible for all activity that happens under your account.

Your account is personal and non-transferable. You may not sell, rent, or share it. You have no ownership interest in the account itself; all rights in the account belong to Hallufox. We may suspend or terminate accounts that violate these Terms or any of our policies.

4. Paid services, subscriptions and tokens

Some features are available only through payment, such as subscriptions or virtual tokens. By purchasing, you agree to the price and billing terms shown at checkout, and you are responsible for all applicable fees and taxes.

  • Subscriptions renew automatically until you cancel. You can cancel at any time before the next renewal date.
  • Virtual tokens have no cash value, are not transferable, and cannot be exchanged for money except where required by law.
  • Billing, cancellations, and refunds are governed by our Refund & Billing Policy.

We are not responsible for fees charged by third-party app stores or payment platforms that we do not control.

5. Your content and the license you give us

"Content" means everything you input into the Services (prompts, messages, instructions, uploads) and the outputs generated in response.

You keep the intellectual property rights you already hold in your input. We do not claim ownership of it. You represent and warrant that you have all rights needed to submit your input and that it does not violate the law or our policies.

To operate and improve the Services, you grant Hallufox a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, adapt, display, and otherwise use your Content for the following purposes only, and consistent with our Privacy Policy:

  • providing, maintaining, and securing the Services;
  • enforcing our policies and keeping the platform safe (including content moderation);
  • improving our products and developing new features; and
  • training and improving our AI models, moderation tools, and related technology.

You may request deletion of your Content as described in our Privacy Policy and Content Removal Policy.

6. Acceptable use and prohibited content

You must follow our Acceptable Use Policy and Prohibited Content Policy. Among other things, you must never use the Services to create, request, upload, or share:

  • any content that sexualizes, depicts, or endangers a minor in any way (zero tolerance — see our Underage Policy);
  • non-consensual intimate imagery, or sexual or nude depictions of real, identifiable people created without their consent;
  • content that promotes terrorism, violent extremism, human trafficking, or serious real-world harm;
  • content that infringes someone else's intellectual property or privacy; or
  • malware, fraud, harassment, or anything illegal where you live or where the Services are provided.

Violations may result in immediate removal of content, suspension or termination of your account, and, where required, reporting to the relevant authorities.

7. Intellectual property

The Services, including the software, design, logos, the "Hallufox" brand, and platform-provided AI Characters and media, are owned by or licensed to Hallufox and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. This is not a transfer of ownership and ends automatically if you breach these Terms.

If you send us feedback or suggestions, we may use them freely without any obligation or compensation to you.

8. AI-specific disclaimers

Please keep these points in mind whenever you use the Services:

  • For entertainment only. The Services are not a substitute for professional advice and are not a source of emotional, medical, legal, financial, or crisis support. If you are in distress, please contact a qualified professional or a local emergency or crisis line.
  • AI Characters are fictional. They are software simulations. They have no real feelings, intentions, or ability to act in the real world. Any statements that resemble real-life promises, offers, or meetings are not real and should not be relied on.
  • Outputs can be wrong. AI-generated content may be inaccurate, incomplete, offensive, or otherwise unreliable. You are responsible for evaluating any output before relying on it.

9. Third-party services

The Services may link to or integrate third-party websites, apps, or tools that we do not control. We are not responsible for their content, practices, or policies. Your use of them is at your own risk and subject to their terms.

10. Suspension and termination

You may stop using the Services and close your account at any time. We may suspend, restrict, or terminate your access — with or without notice — if we reasonably believe you have violated these Terms or our policies, if required by law, or to protect the Services or other users. Sections that by their nature should survive termination (for example, content license for already-processed data, disclaimers, liability limits, and dispute terms) will continue to apply.

11. Disclaimers of warranty

To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or that any output will meet your expectations. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

12. Limitation of liability

To the maximum extent permitted by law, Hallufox and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising from or relating to your use of the Services. Our total aggregate liability for all claims will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD 100. Nothing in these Terms limits liability that cannot be limited by law.

13. Indemnification

You agree to indemnify and hold harmless Hallufox, its affiliates, and their staff from any claims, damages, losses, and reasonable legal costs arising from your Content, your use of the Services, or your breach of these Terms or applicable law.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Cyprus, without regard to conflict-of-law rules, and subject to any mandatory consumer-protection rights you have where you live. Before starting any formal proceedings, you agree to first contact us so we can try to resolve the dispute informally. If you are an EU or UK consumer, you keep the mandatory protections of your country of residence.

15. Changes to these Terms

We may update these Terms from time to time. If a change is material, we will take reasonable steps to notify you (for example, by posting a notice or updating the "Last updated" date above) before it takes effect. Your continued use of the Services after the changes become effective means you accept the revised Terms. If you do not agree, please stop using the Services.
